Terms & Conditions
Terms and conditions of hire
Please read these terms and conditions of hire before you make a booking. When receiving a booking from a client by phone, E-mail or post, we will take it that you have read and understood the terms and condition on this page.
Payment:
When making a booking 50% of the total balance is due immediately to confirm the booking and to secure the date. This payment can be paid by bacs into the relevant bank account or by cheque. Once the cheque has cleared, or bacs payment has cleared into the bank account, we will then treat the booking as guaranteed and secure the date.
The remaining balance must be paid in full, at the latest 7 day’s prior to the event date.
If the remaining balance hasn’t been made and cleared within this time frame, First Class Effects & Entertainments hold the right to cancel their services and keep any monies paid and the customer will still owe any outstanding balance, unless the event was cancelled with over 5 days notice of the event date and then just the deposit will be kept by foam fun.
If otherwise agreed.
Deposit to be paid at time of booking to confirm booking and hold date.
And remaining balance to be paid.
Before the function starts in cash to the operator and before equipment is used. If payment has not been received at the start of the event in cash all equipment will be removed from site. Please Note: if we turn up at the agreed venue/site and the function/hire is cancelled.
First Class Effects & Entertainments must still be paid in full for the hire.
Delivery:
We Supply our equipment delivered and staffed, Foam Fun cannot be held responsible for late delivery due to unforeseen circumstances for example breakdowns, bad weather, act of God or traffic jams.
The Venue:
It is the responsibility of the client named on the contract to provide a safe working environment, ensuring that:-

Sufficient access is available for the loading and offloading of the equipment.

The venue has the required access and area required, to allow the equipment to be set-up safely.

A cornered off area away from the general public for Foam/Snow cannons.

The area where the equipment is to be set-up is clean, and does not contain any substances such as, oil, paint, or any sharp objects such as glass, metal, or wood, which may cause injury or damage to any persons or equipment.

First Class Effects & Entertainments reserves the right to refuse the operation or hire of our equipment if we believe that the venue is unsuitable or unsafe to operate in.

Nightclubs and late night venues: We will require one appointed security person at the cost of the hirer to oversee the safety of equipment/operator whilst on site and in use at least 2 meters from the equipment at all times.

First Class Effects & Entertainments cannot be held responsible for warped or damage flooring, seating or sound & lighting equipment that might get Damaged.​
Foam Pit
Please note, when booking the Inflatable Foam Pit. It requires as sufficient space to accommodate the pit which is 15 feet x 15 feet and 11 feet in height. This space needs to allow at least two feet free space around the sides and back of the pit and also an adequate space at the front entrance for people to get in and out safely.
It is the client who is also responsible, for making sure the area of which the pit is to be set up in, is of safe ground. Level ground and free from debris.
First Class Effects & Entertainments can withdraw services, at full charge on arrival, if these conditions are not met and feel, that this is either going to cause
damage to equipment or risk peoples safety. This also goes for weather conditions. Please see weather section.
Responsibilities:

It is your responsibility as the client to make sure that no glass or anything sharp is allowed near, or in the area of the foam. If drinks are
to be taken into the foam area, then these must be in disposable soft plastic, paper or polycarbonate form. -
We are not responsible for any clean up at the end of the night.

We are not responsible for any residue that may be left over. That if not cleaned up may lead to damage or any other problems caused.

The client is fully responsible for the clean up procedure, unless otherwise agreed, at the same time of making the booking with us and a clean up service is agreed and paid for.
Participant Behaviour:
It is at our discretion as the supplier as to whether or not the hire should be closed down for reasons such as:-

The participants are acting in an abusive or aggressive manner towards staff.

The conditions are proving to be too dangerous. Should this happen then the full total cost shall still be payable by the named client on the contract.
Weather Conditions:*
In the event of use being prevented from hiring & setting up equipment due to inclement weather conditions such as real snow, winds, rain, or any circumstances beyond are control, and we are instructed to arrive, all payments must still be paid in full . We do however offer you the chance to reschedule for an alternative day of your choice if this is cancelled in due time and providing the equipment is available for the date you require. (*for outside events only).
Public Liability Insurance:
First Class Effects & Entertainments carries Public Liability Insurance of five million pounds.
Mains power supply:
You the client, must ensure that x2 mains 13amp-power supplies are available for our use that is within 5 meters of where our equipment is to be set up unless we have agreed different.
Mains Water Supply:
You the client, must ensure that there is a sufficient water tap easily available, for our operator to fill the water drums.
Forms of payment:
Booking fee can be paid by bacs or cheque, but only when the funds are cleared will the booking be secure / Remaining balance must be received 7 days prior to the event and also cleared by then. Unless otherwise agreed.
Cancellations:
Any cancellations must be received in writing at least five working days before event date otherwise you will be liable for paying the total hire fee as shown on your contract. All moneys that have been paid are none refundable when cancelling any bookings.
Disputes:
If the client is unhappy with the service that First Class Effects & Entertainments, have provided for any reason the full payment must still
be paid, legal action will then be arranged by both parties in a court of law.
Agreement:
This is an agreement between us First Class Effects & Entertainments trading as the company and you the client. This agreement starts from the date you make a booking, so unless a written cancellation is received 7 working days before your event date you are liable for all costs on your contract in full.
